Terms of Service

bench.cx lets you track sealed Pokémon product, look up price history and specifications, and set free price alerts. The Service is provided for informational purposes only.

A wholesale marketplace is planned but not yet available. When it launches it will be governed by separate, additional terms.

bench.cx is not a financial adviser, broker, or dealer, and nothing on the Service is financial, investment, tax, or legal advice. Prices are estimates drawn from third-party sources and may be inaccurate, incomplete, or delayed. Sealed collectibles are a volatile, illiquid, unregulated market. Do your own research and do not rely on bench.cx for financial decisions.

You are responsible for your account and for keeping your credentials secure. Provide accurate information and keep it current. You must be at least 13 years old, or the age of majority where you live, to use the Service.

You agree not to:

• Use the Service unlawfully or to infringe the rights of others.
• Scrape, crawl, or bulk-download the Service except as we expressly allow (for example, the embeddable price widgets).
• Interfere with, overload, or attempt to gain unauthorized access to the Service.
• Reverse engineer or resell the Service.
• Misrepresent your affiliation with us.

Data you add, such as your holdings, lots, and notes, remains yours. You grant us a limited license to store and process it solely to provide the Service to you.

The bench.cx name, logo, software, and original content are owned by us. Product names, images, and related materials are the property of their respective owners.

bench.cx is an independent service. It is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Wizards of the Coast, TCGplayer, eBay, or any other rights holder. “Pokémon” and related marks are trademarks of their respective owners and are used here for identification and reference only.

Prices, images, and other product data are provided by third parties and offered on an “as is” basis. We do not guarantee their accuracy. The Service may link to third-party sites that we do not control.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

To the fullest extent permitted by law, bench.cx and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100).

You may stop using the Service at any time and can delete your account whenever you like. We may suspend or terminate access if you violate these Terms or to protect the Service.

We may update these Terms. We will change the “Last updated” date above, and material changes take effect when posted. Continued use of the Service means you accept the updated Terms.

These Terms are governed by the laws of the United States and the state in which bench.cx is established, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute relating to the Service.
